Independence, Missouri Personal Injury & Auto Accident Case Review
The following case is representative of the motor vehicle accident cases that Horn Law handles in Independence, Missouri. Independence is served by the Circuit Court of Jackson County, Missouri at the Independence Court House, located just off the historic Independence, Missouri Square on Kansas Ave.
This recent case involves an auto accident that happened on 23rd Street in Independence (also referred to as Missouri 78 Highway). Our client was driving east on 23rd when the defendant driver broadsided our client’s vehicle on the driver’s side. The severe force of impact propelled the east bound vehicle across the lanes and into a private drive on the north bound side of 23rd Street.
Our client suffered a sudden onset of serious injury and was transported by ambulance to Centerpoint. Our client was stabilized in the emergency room and admitted to the hospital.
As soon as Horn Law was notified, we conducted an immediate accident scene investigation in order to preserve important evidence, including measurements of vehicle skid marks that were present in the curb lane of 23rd Street. Pictures of the vehicles were also obtained at the salvage yard where both vehicles had been towed by an Independence, Missouri tow service.
The collision was also investigated by the Independence, Missouri Police Department. Our investigations revealed that the adverse driver was driving a pick-up and there was no obstruction to vision. A citation was given for failure to yield. The defendant driver was insured by State Farm Insurance Company.
During case discovery, it was discovered that the defendant was distracted by a cell phone and liability was aggravated. Our client’s injuries caused a permanent physical limitation. The case was successfully resolved through court-ordered mediation. Horn Law was able to maximize our client’s settlement because of our early investigation, accident reconstruction work, and the call detail records which allowed us to prove that the defendant was on the cell phone at the time of the collision.
